Júcar Hydrographic Confederation (CHJ) has decided to terminate the disciplinary proceedings initiated in 2015 against Benidorm City Hall and the private school Lope de Vega by occupation of the bed of Barceló ravine "to have been no negligence or willful conduct." The Water councilman José Ramón González de Zárate, has reported that the CHJ has notified the cancellation of this sanction, amounting to 65,883.33 euros, considering the arguments put forward by the City Hall and by the school center. In these allegations both argued, among other things, "that the bed of the ravine is not defined in the subject of the complaint, as it is found in the specific regulations and studies by the basin organization itself." Zárate explained that the CHJ started this sanctioning process "for the possible commission of a serious breach of the Water Law holding that had occupied without authorization the bed of the ravine with the sports facilities of Lope de Vega". However, as stated in the letter sent now to the City Hall from CHJ, there is a report of own basin organization 2008 which states that "a defined channel is not observed" the ravine in this area, that it "neither figure as an area at risk of flooding in the PATRICOVA (Territorial Action Plan on the Prevention of flood risk in Valencia) ", that sports facilities" are not located in the public Water or police area public channel ". The head of Water has clarified that the review of PATRICOVA "today this area itself is considered floodable", although it has stated that "since 2008 the City Council has conducted actions aimed at channeling the ravine and thereby avoid flooding that recurrently they occur in the area. " Thus, this year the project of channeling the ravine between Zamora and Toledo streets, valued at 993,320.24 euros and could only run the section between Zamora and Ciudad Real street. Zárate recalled that currently through a grant from the Provincial Council of Alicante is being drafted the project to channel the section between the streets Ciudad Real and Bernat de Sarrià, saving the area that was the subject of disciplinary proceedings now dismissed. The mayor stressed that "we have shown that now, as in the previous period of PP government has acted to resolve the channeling of the ravine, unlike what was done since late 2009 to June 2015".
