The local government transfers the information provided by the lawyer on behalf of the owners to the Board of Spokesmen on the legal situation of the possible demolition
Benidorm also requests an appointment with the Minister of Environment for the sentence of the Supreme Court on the towers of Punta Llisera
The mayor of Benidorm, Toni Pérez, has requested a meeting with the Minister of Environment, Isabel García Tejerina, following the ruling recently issued by the Superior Court of Justice of the Valencian Community (TSJ) that affects the Punta towers Llisera This request is added to the one already sent in the same direction to the Minister of Housing, Public Works and Vertebration of the Territory, Mª José Salvador.
The Councilor for Urban Development, Lourdes Caselles, explained that both appointments have been requested "because the General Administration of the State and the Regional Ministry are part of this procedure, but not the City Council". Therefore, both administrations have all the information regarding the legal and legal situation of the matter.
Caselles has made these statements at the end of a Board of Spokespersons in which the groups of the corporation have been informed about the meeting held yesterday "with the lawyer representing about 60 owners" of the towers, which was transferred to the City Council on content of the judgment of the TSJ. The mayor said that in that meeting, the lawyer said that "the Regional Ministry has filed an appeal for reversal against the writ of execution of sentence" Valencia high court, which gave a period of three months to tear down the two blocks of housing.
Also, this legal representative told the City Council that after this appeal for replenishment "also fit for reform remedies" by those affected, which "we understand that they will present to defend their rights." In view of all these resources, "the demolition of the towers dictated by the TSJ will not be imminent."
The head of Urbanism has indicated that, in any case, the City wants to have information from all parties involved in this procedure and hence have requested meetings with the minister and the consellera.
When asked by journalists, Caselles clarified that the only procedure linked to the towers of Punta Llisera in which the City Council was represented was that related to the granting of the occupation license. A procedure in which "both in first and second instance" the courts have given the reason to the City Council, saying that "municipal licenses were well given", since the building "met the urban requirements." This procedure was resolved in the TSJ last May.
The mayor recalled that "at no time has spoken of illegality" in the granting of licenses of the towers by the City Council, and that the Supreme Court ruling in 2012, which derives the current order execution sentence, makes reference to "the license granted by the Conselleria".
