The plenary session will approve next week to accept the instructions of the Court and not appeal to judicial proceedings
The City Council will redo the specifications of the street cleaning and waste collection contract, adapting them to the TACRC resolution
Benidorm City Council is going to redo the contract specifications for street cleaning and urban solid waste collection to adapt them to the resolution of the Central Administrative Court of Contractual Resources (TACRC), which has annulled several points of the specifications for the tender of this contract approved in the plenary session last December. The proposal to remake these documents, raised by the mayor of Street Cleaning, Luis Navarro, will be approved next Wednesday in a plenary session, after this Friday it has been ruled on by the Internal Regime Information Commission as a prior step to its inclusion in the order of the day.
As reported days ago, after learning of the TACRC resolution, the mayor of Benidorm, Toni Pérez, commissioned the Contracting, Intervention, Engineering and Secretariat departments to prepare technical reports to adopt the relevant decisions. In these reports, the municipal technicians recommend, on the one hand, accepting the resolution of this Court and not appealing it to the Superior Court of Justice of the Valencian Community through the Contentious-Administrative route, since this procedure could delay the procedure even more; and, on the other hand, redo the technical and economic documentation, as well as the specifications of administrative clauses and technical prescriptions, incorporating the indications established by the TACRC, to be able to restart the bidding again.
Likewise, the motion that will be debated in plenary also contemplates notifying this agreement and the resolution of the TACRC to the three companies that submitted offers to this tender, for them to appear at the Contracting Department, to check the status of the offers presented and proceed to withdraw them; preserve all the acts and procedures incorporated into the contract file 106/2021 for the Urban Solid Waste Collection and Cleaning of Public Spaces Service Contract, not affected by the Court's resolution; carry out all consultations with advisory bodies that are mandatory; and, finally, notify the Central Administrative Court of Contractual Resources of the acceptance of its instructions.
