The City Council raises an event of nullity against the last sentences of Subzone C
Benidorm City Council has filed an annulment incident against the latest judgments regarding the final settlements of the special contributions of Subzone C issued by the Contentious Administrative Court number 4 of Alicante. Specifically, it concerns two judgments of the past 24 November and the order of 18 December, issued as a result of the remedy of correction and complement proposed by the City Council on them.
This has been agreed on the basis of the technical recommendations of the legal adviser, the municipal secretary and the technicians of the economic area during the Board of Spokespersons held this morning, which has been attended by representatives of all municipal groups and not attached councilors.
In the aforementioned judgments, the magistrate annulled the final settlements made to the owners for the urbanization works of this sector to subsequently order their revision. A review requested by the owners and that the City Council has already started ex officio.
In the nullity incident filed today, the City Council reiterates that there is a contradiction between what was decreed by the judge in point one of the judgments of November - the annulment of the final settlements - and what was set in the two - the official review - .
As has been stressed in the Board of Spokespersons, the presentation of the nullity incident does not affect the procedure to officially review the final settlements, which the City Council is continuing to implement, as requested by the residents.
