Agricultural burning

Authorizations and conditions to be met to carry out the controlled burning of agricultural pruning remains.

Who can request it?

  • Be of age
  • The applicant must prove his or her legal age using his/her D.N.I. or N.I.E.

EXTRAORDINARY MEASURES

  • Burning permits will be automatically cancelled and prohibited when strong winds blow or a pre-emergency or alert situation is declared by the Department of the Environment. The alert level, as well as its forecast for the next day, can always be known by calling any of the following telephone numbers: 96.515.08.10 or 112.

GENERAL RULES 

  • You must carry the permit with you and show it when any authority requires it.
    Remain to monitor the fire until it is completely extinguished and have sufficient means to control it.
    Carry out the burning by concrete blocks, closed at the top to prevent the escape of embers.
    It will form a firebreak around the area to be burned, which will not be less than 2 metres

RESPONSIBILITY

  • RESPONSIBILITY FOR DAMAGES TO THIRD PARTIES, BOTH CIVIL AND CRIMINAL, WILL FALL ON THE OWNER OR OWNER OF THE PROPERTY.

Deadline for application

  • 7 days before the burning is intended to be carried out.

    Duly completed form or application. (Attached document)
    DNI photocopy. (Photocopy of the D.N.I. of the owner of the property, lot or plot)
    Location map. (Topographic map of the location of the lot, farm or plot)
  • If the person who carries out the burning is different from the owner of the property:
    Authorization in favour of third parties of the owner.

VALIDITY OF THE AUTHORIZATION

  • From October 15 to December 31, of the current year.
    From January 1 to May 31 (except Holy Week dates, from Maundy Thursday to Saint Vincent Monday, both inclusive) of the following year.
    From dawn until 11:00 a.m. and on the corresponding days depending on whether the zone is even or odd, PREVIOUSLY check THE PRE-EMERGENCY LEVEL OF THE DAY (burn only with Level 1)

 Information about the processing of your data.

The interested party is informed that their data will be processed by Benidorm City Council (Controller), with CIF P-0303100B, and address at Plaza SSMM Los Reyes de España, 03501, Benidorm, Alicante, and incorporated into the corresponding treatment system according to the application submitted.

Data Protection Delegate: Benidorm City Council has the support and appointment of the Data Protection Delegate, whose contact details are: dpd@benidorm.org.

Purposes: your data will be processed to manage the application submission process in the terms provided therein and those other necessary to comply with administrative regulations, such as contacting you if necessary.

Legitimation: the processing of your data is legitimized in compliance with a legal duty of the person responsible derived from Law 39/2015 Common Administrative Procedure of Public Administrations.

Deletion period: the data will be kept for the time necessary to fulfil the purpose for which it was collected and to determine the possible responsibilities that may arise from said purpose and the processing of the data. The provisions of the files and documentation regulations will be applied.

Recipients: the data may be transferred in the cases legally provided to:

All those administrations that, based on Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations, request the information of the interested party for consultation, verification or use.
Those entities, public and/or private, with which Benidorm City Council is required to share their data to provide the request.
International transfers: international transfers of data are not planned.

Automated decisions: no automated decisions are made.

Exercise of rights: to exercise the rights that apply by data protection regulations (access, rectification, deletion, opposition, limitation, portability, as well as not to be subject to decisions based solely on the automated processing of your data, when appropriate) regarding the processing of your data, by writing to the City Council or the general registry by email to the following address: dpd@benidorm.org, providing a copy of your DNI or equivalent identification document. You may contact the Spanish Data Protection Agency (www.aepd.es) to file a claim when you do not consider your request has been duly attended to.
