According to the agreement signed in 2006, Prometosa must contribute this amount within a maximum period of 60 days and urbanize the sector in 36 months
Benidorm registers the land division of El Murtal and requires the developer to pay the first payment of 1.2 million
Benidorm City Council has already registered in the Property Registry the parceling project of the PAU 1-El Murtal, a sector of more than 900,000 square meters in which a maximum of 2,942 homes can be built. The Town Planning Councilor, Lourdes Caselles, explained that “after solving different legal and registration vicissitudes, the forced parceling project is already registered, so from this moment the calendar of this PAU is launched, both from the urban and economic point of view ”.
Caselles has specified that according to the agreement signed in 2006 by the City Council and the developer, Prometosa, "urbanization works must be carried out within a maximum period of 36 months from the registration of the reparcelación in the Property Registry". But in addition, from the inscription and in a period of two years, the urbanizing agent must contribute another 6 million euros for “the execution of extrasectoral public works that the City Council decides in accordance with the planning”, as well as to pay the deposit of water supply.
At this point, the mayor recalled that in the offer presented at the time by Prometosa to become a development agent, the development of this sector resulted in 8.5 million euros for the City Council. At the signing of the agreement, the City Council already received 1.2 million euros. The remaining amount, according to the agreement, would be materialized from a key moment: the inscription of the reparcelación project in the Property Registry. In fact, 60 days after that registration you have to receive another 1.2 million euros.
Hence, in the proposal signed by Caselles, which will be addressed in the next Urban Planning Information Commission, the City Council requires the developer to pay those 1.2 million euros committed within the stipulated period of 60 days. Likewise, the payment of the invoice corresponding to the registration in the Registry, which amounts to 122,127.23 euros, is also required.
Following the calendar set in the agreement, after the payment of those 1.2 million euros, the developer must contribute the rest, until reaching 6 million euros, in 24 months; an amount that will be translated into public works.
The 1.3 million euros that would subtract up to 8.5 million offered in the day by the developer will not be entered into the municipal coffers, since initially they will compensate the urbanization charges that correspond to pay the City Council for the land that It has in the sector.
The head of Urban Planning has added that "to date the development of this sector has been stagnant and contingent upon the numerous judicial appeals filed by the urbanization agent, which have mostly been resolved in favor of the City Council." At the moment, "there is only one living resource left, the one presented by Prometosa against the payment to the net creditors of just over 60,000 euros made by the landowners to unlock the sector."
