The City Council stands in solidarity with the irrigators of the region and demands a "fair and reasonable" price from the EPSAR for the reclaimed water it supplies

The plenary session approves the initiation of a disciplinary file against the Blue Zone concessionaire company for undue charging of users

24 April 2023
Pleno Abril 2023

The plenary session of Benidorm City Council held today has approved the opening of a disciplinary procedure against the concessionary company of the regulated parking service due to the two very serious infractions derived from the improper collection of management expenses and other breaches that, according to in the reports, “they are still being produced”.

The approved proposal reflects seven non-compliances, for which it has been agreed to notify the concessionaire, that if the commission of the acts constituting a contractual infringement is proven, it may lead to the imposition of sanctions, as well as the termination of the contract, for breach of essential obligations thereof.

Likewise, the concessionaire will be required to cease the commission of the infractions detected within a maximum period of five days and the reimbursement of the fees improperly accrued to the users of the ORA zone. The Councilor for Mobility, José Ramón González de Zárate, indicated in this regard that "we defend the general interest and that of users". The mayor stated that "what we do is comply with the law to the letter." In the same way, he recalled that "the current specifications were not made by this government, but in any case, we are not going to allow the company to do what it wants". At that point, he insisted that, as was said at the time, “we were not going to take action until we had the technical reports, which is what we do now. We ensure compliance with the law by demanding everything that is included in the specifications”.

Unanimously, the plenary session has shown its support and solidarity with the Irrigation Community of the Bajo del Algar Canal "in their demands" after the Public Entity for Residual Water Sanitation (EPSAR) has increased the price of water by 117% regenerated that supplies the irrigators of the region, which has gone from 0.24 euros/m3 to 0.49 euros/m3. Support and solidarity extends to other affected irrigation communities.

The Councilor for the Water Cycle, José Ramón González de Zárate, stressed that "irrigators are fundamental in the history of water in the city and our region", since "they gave the white water to the municipalities for supply" to change to using reclaimed water to irrigate their crops. For this reason, he has influenced, "we do not understand the action of the EPSAR", which with this increase in costs "is causing the end of agriculture in this area."

"The irrigators have given us everything and now they only ask us for what is fair: a reasonable price," he added.

Likewise, he has recalled the need and importance of having a pond for the storage of reclaimed water next to the treatment plant as soon as possible; an infrastructure claimed four years ago by the Marina Baixa Water Consortium and that until now the Ministry had kept blocked. This pond, he explained, would allow the surplus of reclaimed water that is generated in summer to be stored for use at other times of the year.

The approved agreement also includes requesting EPSAR to "reconsider the application of the price review criteria for treated water supplied to irrigation communities, considering their special vulnerability and establishing homogeneous parameters between basins", to "maintain the water and economic balance of the current management model”.

Also unanimously by the political groups, the proposal of the Town Planning Councilor to approve the Deloix hotel's Interior Reform plan has gone ahead by which the company that manages the establishment will pay the City Council 371,426.91 euros as consideration for having accepted punctual modification number 1 of the PGOU, an amount that will go to the Municipal Land Heritage.

The Councilor for Town Planning, Lourdes Caselles, has indicated that with this proposal "what we do is work and enable these large hotels and their investments to give relevance to their hotels while making the corresponding consideration to the City Council" and has clarified that this is not This prevents us from "continuing to support hotel renovation, which is allowing us to go from three to four stars or four stars higher".

Also in urban matters, the draft of the urban agreement has been approved to execute the Interior Reform Plan (PRI) of the Magic Villa de Benidorm 3 hotel with the new economic parameters resulting from the alteration of the cadastral value. "What has been done is to repair errors" explained Lourdes Caselles, "which gives a lower buildable load than that adopted in previous years. The company is also asked to provide, before the signing of the urban agreement, the consolidated documentation of the PRI in which the new economic parameters are collected.

In the same session, and again unanimously, the act of payment and occupation of a new property within the expropriation project promoted by the City Council for the construction of the Discotheques road has been ratified. Caselles highlighted "the great work of the municipal technicians to mutually agree on the acquisition of practically all the land" necessary for this work, which "is already tendered" and for which "the loan has already been requested" with which the project will be executed.

Regarding this access project to the industrial estate from the N-332 and its connection with the urban fabric, the mayor has reported that "today the approval of the Generalitat Valenciana Railways has arrived at the work"; an approval "that was mandatory" and with which "one more step is taken for the execution of this work and to be able to put the Partial Plan 3/1 into operation".

In the section on extraordinary dispatches, the liquidation of the 2022 budget was reported, which yields a Treasury Remaining for General Expenses of 13,139,106.67 euros, of which a large part will be allocated to social spending and to boost the economy, such as the mayor, Toni Pérez, advanced last Friday.
