The organ endorses the municipal proposal to annul the surface right in favor of the SPTCV and replace it with a public concession
The mayor calls a Board of Spokespersons to address the opinion of the Consell Jurídic Consultiu on the agreement of the cultural center
The mayor, Toni Pérez, has convened a Board of Spokesmen next Monday to address the opinion of the Consell Jurídic Consultiu (CJC) on the feasibility of reviewing and declaring the nullity of the agreement signed in 2006 between the City Council and the Society. the Valencian Community (SPTCV) for the construction of the cultural center, and proceed to the signing of a new protocol agreed between both parties to reactivate the works of this infrastructure.
The City Council approved last August to start the file to change the legal figure by which the floor on which the unfinished building stands was made available to the SPTCV. The municipal proposal is to declare the nullity of the surface right that was granted to the SPTCV and its replacement by a public concession, a legal figure that is exempt from VAT.
This change is not minor, since the right of surface has generated to the City council a disbursement of around 1.5 million euros in concept of VAT of the floor, and that would be annulled if the right of surface were replaced by a concession.
The CJC has endorsed the formula proposed by the City Council, and ruled that "the official review and declaration of nullity of the agreement signed on June 21 and the plenary agreement of November 30, 2006, which agreed to the constitution of the surface right in favor of SPTCV ".
Apart from establishing the public concession, the protocol agreed by the City Council and the SPTCV includes that the investment announced by the Valencian government for the cultural center is contemplated as a first phase of work in which the smaller room of 546 seats is executed, the professional music and dance conservatory, and the cafeteria, and in which the treatment of the facades and roofs of all these areas is also carried out.
The mayor has indicated that this Opinion, which this morning has been transferred to the Corporation, will be studied by the Board of Spokespersons, to proceed to the drafting of the proposal, after analysis and opinion of the Informative Commission of the Internal Regime next Wednesday, it will be included in the order of the day of the next ordinary plenary session, the one corresponding to the month of January, to celebrate on Monday, the 29th.
