The plenary session will vote to liquidate the contract of the bus station and its new tender

El pleno votará liquidar el contrato de la estación de autobuses y su nueva licitación

The plenary session of the corporation will debate on Monday the proposal to liquidate the contract with the company that manages the bus station of Benidorm and to approve the bidding conditions that will govern the tender and the new contract. The proposal, which meets a ruling of the Superior Court of Justice of the Valencian Community (TSJ) that obliged to tender the facilities again, has been ruled today in a briefing committee of the Internal Regime and is based on the reports from the departments of Secretary, Intervention and Contracting.

Based on all these reports, this provisional settlement of the contract before the planned period "involves a series of rights and obligations for the City Council and for the contractor, Benidorm Bus Station SL", as indicated by the councilor of Contracting , Lourdes Caselles.

Thus, and after the assessment made at the request of Intervention and on the percentages set by Urbanism approved in 2014 by the plenary session, "in favor of the contractor is recognized the amount of 29,773,544.31 euros, plus the tax on the added value" . Of this amount, just over 27.2 million euros correspond to the value of the work legally adjudicated and exploited -with its corresponding industrial benefit-; and the remaining 2.5 million euros, to the work that was done without a license and that was not able to be used.

Caselles clarified that "to those 29.7 million euros you have to deduct works already amortized in the ten years that the station has been in operation," so "the figure will be reduced." In any case, she stressed that "the payment of the amount that corresponds to Benidorm Bus Station SL will be done once the new contract is awarded, in no case before, and provided it is a new company which assumes the management and operation of the facilities. "

The City Council, meanwhile, will be entitled to enter the annual fee collected in the contract and that the company has not paid since the station came into operation in 2007. The councilor of Contracting explained that "it has been possible to fix a part of the canon, that of the period 2007-2013, since the company presented the balance sheets of these years "; a fee that amounts to 109,992.04 euros. However, "it is pending to calculate the canon for the years 2014, 2015, 2016 and 2017 because the company has not contributed yet to the City Council the corresponding balance sheets".

The proposal also includes processing the sanctioning dossier on the works that the merchant built without a license and which were already legalized by decree in the previous legislature - March 2015 -. In addition, the company will have to liquidate taxes and municipal taxes corresponding to that area.

If the proposal is approved and after giving an audience to the contractor, the City Council will receive the urbanization works of the roads around the station, on which there is a bail of just over 100,000 euros to address the deficiencies detected.
