The mayor signs the resolution in line with what was requested by the neighbors

Benidorm assumes to review ex officio the final settlements of Subzone C

07 December 2017
Benidorm asume revisar de oficio las liquidaciones definitivas de la Subzona C

The City Council of Benidorm is going to initiate the procedure to officially review the final settlements of the special contributions made to the owners of Subzone C on account of the urbanization works on the streets of this neighborhood. In a decree signed today by the mayor, Toni Pérez, the City Council assumes as requested by the neighbors.

In addition, with this decision the City Council meets, in turn, with what was recently ordered by a court in Alicante. Specifically, the judge urged to review ex officio those final settlements, thus voiding a plenary agreement last February in which the request made in this regard by the owners was inadmissible.

Parallel to the ex officio review, the City Council has proposed remedies to rectify and complement the first point of the judgments handed down in recent weeks by this court in Alicante. And is that, according to municipal technicians and legal advisers, there is "a contradiction" between what was decreed by the judge in point one of the sentence and what is set in the two, since first cancels the final settlements and then orders their review.

Before the doubts arisen around the judicial decision, and as already it was exposed in Board of Spokesmen, the City council has presented the mentioned remedies of rectification and complement.

The total value of the definitive settlements turned in by the City Council to the owners as a whole amounted to around 2 million euros.
